Incarcerated is a trait applicable to an individual who is legally imprisoned, that is, to an individual who is held by the state in accordance with law, either in anticipation of a trial before a court or as a result of being found guilty and condemned to incarceration by a court. An individual who is kidnapped by a cult or by the state and locked away secretly in a dungeon is imprisoned but not incarcerated.
